Terms of Service

1. Account and Access

You must be at least 18 years of age and have authority to bind your organisation to these Terms to create an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

You agree to notify us immediately at security@albaspot.com if you suspect unauthorised access to your account. We are not liable for loss or damage resulting from your failure to keep credentials secure.

2. Acceptable Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service to register, manage, or transfer domains for illegal purposes or to facilitate spam, phishing, or fraud
• Attempt to access accounts, data, or systems you are not authorised to access
• Circumvent, disable, or interfere with security-related features of the Service
• Reverse engineer, decompile, or extract source code from the Service
• Use automated tools to access the Service in a manner that exceeds normal usage patterns without our written consent
• Resell or sublicense the Service without our express written permission

We reserve the right to suspend or terminate accounts that violate this section without prior notice.

3. Service Level and Availability

We aim to maintain high availability of the Service and will make commercially reasonable efforts to minimise planned and unplanned downtime. In the event of a service disruption:

• We will communicate status updates via the Albaspot status page or direct notification
• We will work to restore the Service as quickly as reasonably practicable
• Planned maintenance will be scheduled during low-usage windows and communicated in advance where possible

The Service is provided "as is" with respect to availability. We do not guarantee uninterrupted access and are not liable for loss arising from service interruptions outside our reasonable control, including infrastructure failures, third-party provider issues (including Cloudflare, domain registry systems, and DNS infrastructure), or force majeure events.

4. DNS and Domain Actions

The Service enables you to make changes to live DNS records and domain configurations on behalf of your clients. You acknowledge that:

• DNS changes are propagated to public infrastructure and may take time to propagate globally
• Incorrect DNS or domain modifications can cause service outages for your clients
• You are responsible for reviewing and approving all DNS record changes before applying them
• Domain transfers, deletions, and registrations are subject to ICANN policies and registry rules
• We are not responsible for downstream consequences of DNS or domain changes you make through the Service

The audit log provides a timestamped record of all actions taken through your account. It is your responsibility to train team members appropriately and to use the access control features to restrict permissions where appropriate.

5. Data Ownership and Portability

You retain ownership of all data you import, create, or manage through the Service, including client records, domain configurations, DNS zones, and DMARC reports.

We do not claim any ownership rights over your data. We use your data solely to provide the Service and as described in the Privacy Policy.

In the event that Albaspot ceases operations or the Service is discontinued, we will provide at least 60 days' written notice and make commercially reasonable efforts to provide data export functionality so you can retrieve your domain and DNS records. Domains registered through the Service remain transferable to any ICANN-accredited registrar; we will not impede or delay a transfer requested during a wind-down period.

6. Billing and Payment

Paid subscription fees are charged in advance on the billing cycle you select (monthly or annual). All fees are non-refundable unless required by law or as expressly stated in these Terms.

Domain registration, renewal, and transfer fees are separate from subscription fees and are charged at the time of the transaction. These fees are governed by the relevant domain registry's policies and are non-refundable after registration or transfer.

If a payment fails, we will notify you and attempt to collect the outstanding amount. We reserve the right to suspend account access for accounts with overdue balances after a reasonable grace period.

You may cancel your subscription at any time. Your access will continue until the end of the current billing period. Cancellation does not trigger a refund of the remaining period.

7. Confidentiality

Each party agrees to keep the other's confidential information ("Confidential Information") confidential and not to disclose it to third parties without prior written consent, except as required by law. Confidential Information does not include information that is publicly available, independently developed, or received from a third party without restriction.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Albaspot shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the Service, including loss of data, loss of revenue, or loss of business opportunity, even if we have been advised of the possibility of such damages.

Our aggregate liability to you for any claims arising under or in connection with these Terms shall not exceed the total fees paid by you to Albaspot in the twelve months preceding the claim.

9. Changes to the Service

We may modify, suspend, or discontinue any feature of the Service at any time. We will provide reasonable notice for material changes. Your continued use of the Service after notice of changes constitutes acceptance of those changes.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by a prominent notice within the Service prior to the change taking effect. If you do not agree to the revised Terms, you may cancel your account before the effective date.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Maryland.
